1. Introduction and Acceptance of Terms

Welcome to tyh.org (the “Site”), owned and operated by Thank You Hashem, doing business as “Thank You Hashem” and “TYH” (“TYH,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the Site, including all content, features, music, videos, articles, podcasts, downloads, and services made available on or through the Site (collectively, the “Services”).

By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, please do not use the Site.

TYH also operates a separate online store at shop.tyh.org (the “Shop”), which is governed by its own Terms of Service and Privacy Policy. These Terms apply only to your use of tyh.org; use of the Shop is governed by the Shop’s own terms.

2. About the Site

Tyh.org is a media and inspiration platform featuring Jewish music, Torah-based articles and podcasts, videos, kids’ content, downloadable materials (such as coloring pages), and related content intended to help visitors connect with their heritage and community. The Site also provides links to our social media channels, WhatsApp community groups, and our online store.

3. Eligibility

The Site is intended for a general, family audience. Certain areas of the Site (the “Kids” section) contain content designed to appeal to children; however, the Site as a whole is operated by and directed to adults, and any account creation, form submission, or newsletter sign-up is intended to be completed by a person 18 years of age or older, or by a parent or guardian on behalf of a child. If you are under 18, you may use the content areas of the Site only with the involvement of a parent or guardian. See our Privacy Policy for more information about children’s privacy.

4. Your Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

Use the Site in any way that violates applicable local, state, national, or international law;
Attempt to gain unauthorized access to any portion of the Site, other accounts, or computer systems;
Interfere with or disrupt the operation of the Site or the servers or networks used to make the Site available;
Use any automated means (bots, scrapers, etc.) to access or collect content from the Site without our prior written permission;
Upload or transmit any viruses, malware, or other harmful code;
Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
Use the contact form, newsletter, or any communication feature to send unsolicited advertising, spam, or unlawful content;
Reproduce, duplicate, copy, sell, resell, or otherwise commercially exploit any portion of the Site or its content without our express written permission.

5. Content and Intellectual Property

All content on the Site — including music, lyrics, audio recordings, videos, articles, graphics, logos, the “Thank You Hashem” and “TYH” names and marks, “You’re Welcome To Connect™,” “A Grateful Life is a Great Full Life™,” and all related trademarks, service marks, and trade dress (collectively, the “Content”) — is owned by TYH or its licensors (including featured artists, contributors, and content partners) and is protected by copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and stream or view the Content for your personal, non-commercial use. You may download materials specifically made available for download (such as coloring pages or wallpapers) for personal, non-commercial use only. Except as expressly permitted, you may not reproduce, distribute, publicly perform, publicly display, modify, create derivative works from, or otherwise exploit any Content without our prior written consent or that of the applicable rights holder.

6. User Submissions

If you submit ideas, messages, testimonials, photos, or other materials to us through the Site (for example, through the “Submit an Idea” or contact form features), you grant TYH a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, adapt, publish, and display that submission in connection with operating and promoting the Site, unless we agree otherwise in writing. You represent that you own or have the necessary rights to any content you submit and that it does not infringe any third party’s rights or violate any law.

7. Third-Party Links and Services

The Site contains links to and integrations with third-party services that we do not own or control, including WhatsApp, Instagram, YouTube, Facebook, X (Twitter), and our online store at shop.tyh.org. When you click on a WhatsApp “join” link, follow us on social media, or visit the Shop, you leave tyh.org and become subject to that third party’s own terms of service and privacy policy. We are not responsible for the content, policies, or practices of any third-party service.

8. Newsletter and Communications

By submitting your email address to subscribe to Site updates, you consent to receive email communications from us about music, Torah content, events, and other TYH news. You may unsubscribe at any time using the link included in each email or by contacting us as described in Section 17.

9. Donations

From time to time the Site may offer visitors the opportunity to make a voluntary donation in support of TYH’s mission. Donations are non-refundable except where required by law or as otherwise stated at the time of donation

10. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT IS ACCURATE, COMPLETE, OR CURRENT.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TYH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless TYH and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may suspend or terminate your access to all or part of the Site, at any time, with or without notice, for any reason, including if we believe you have violated these Terms.

14. Changes to These Terms

We may revise these Terms from time to time. The updated Terms will be posted on this page with a new “Last Updated” date. Your continued use of the Site after any changes take effect constitutes your acceptance of the revised Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of NY, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in NY, and you consent to the personal jurisdiction of those courts.

16. Miscellaneous

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision. These Terms constitute the entire agreement between you and TYH regarding the Site.
